Thus the President of the Association "Ukrkondprom" Alexander commented Baldynyuk relevant decision of the Interdepartmental Commission on International Trade.
"This decision of the Commission may be an important step to address the issue of trade restrictions from Kazakhstan to Ukrainian confectionery", – said Baldynyuk.
According to the President "Ukrkondpromu", recognition at the state level Kazakh side action as hostile and discriminatory indicates the intention of Ukraine firmly defend the interests of domestic producers on foreign markets.
However, As the Baldynyuk, importantly, To this solution did not remain a mere declaration, accompanied by adequate and effective measures, which led to cancellation of the Kazakh side to unjustified decision to close the Kazakh market for Ukrainian confectioners.
Otherwise, the actions of Kazakhstan on ousting Ukrainian products on the domestic market questionable legally methods can be an example unpunished violations of international law protected the interests of Ukraine in Central Asia. Such an example can benefit other countries in the region, in markets where Ukrainian goods compete successfully with local manufacturers.
Alexander Baldynyuk focused on the position of Ukrainian confectionery, which is to liberalize international trade and fair fight on the basis of open competition.

14 September 2011 The Government of Kazakhstan adopted Resolution number 1055 "On the introduction of protective measures on the importation of certain kinds of confectionery", which introduced protective duties for a period of 3 years:
1) in the amount of 30% of customs value, but not less than 0,27 euros for 1 kg on import lollipop, toffee, caramel and other similar sweets, not containing cocoa, classified codes TNZED Customs Union 1704 90 710 0, 1704 90 750 0;
2) in the amount of 49% of customs value, but not less than 0,8 euros for 1 kg on the importation of other chocolates, classified codes TNZED Customs Union 1806 90 110 0, 1806 90 190 0;
3) in the amount of 39% of customs value, but not less than 0,42 euros for 1 kg on the importation of other sugar confectionery and their substitutes, Products made of, sugar substitute, containing cocoa, classified codes TNZED Customs Union 1806 90500 1,1806 90 500 2, 1806 90 500 9.
These measures are, essentially, restrictive, and have a pronounced anti-Ukrainian character, as major importers of Kazakhstan confectionery products are Ukraine and Russia, but the Russian Federation is not subject to duties.
According to the State Customs Service of Ukraine, In January-June 2012 year, that is six months from the date of the introduction of restrictive measures, shipments Ukrainian confectionery products to Kazakhstan fell by 70% the volume of shipments of these products during the same period 2011 year.
23-24.11.2011 during the official visit of Prime Minister Mykola Azarov Ukraine in the Republic of Kazakhstan, Heads of governments of the two countries discussed the possibility of settlement, provided that establish export quotas the LCD pastry with codes of commodity nomenclature, that fell to restrictions, within which will operate a zero duty rate. Association "Ukrkondprom" on behalf of confectionery enterprises in Ukraine in March 2012 was registered in the Ministry of Economic Development and Trade of Ukraine Application for investigation to establish discriminatory and unfriendly actions of the Ukrainian Republic of Kazakhstan respect of confectionery industry.
02.07.2012 the Interdepartmental Commission on International Trade decided number 278, whereby the Commission established that discriminatory and unfriendly actions by the Republic of Kazakhstan and the Ministry of Economic Development recommended to apply to the Republic of Kazakhstan with a proposal to review and dispute situation in order, established in article 19 Agreement on free trade zone CIS, signed 15.04.1994, amended by 02.04.1999.
Association "Ukrkondprom" is an industry association of confectionery, krohmalopatokovoyi and food concentrates industries. Association consists of 18 business, producing about 75% total volume manufacture of confectionery in Ukraine.
